Terms of Service.

I service regions of NSW including: Sydney, Blue Mountains, Mudgee, Southern Highlands, Central Coast, Hunter Valley etc. If the location for your booking is outside of these regions, please specify in your enquiry, as additional fees may be applicable to account for flights/accommodation.

PUBLIC VENUE BOOKINGS

  • For Solo, Duo and Band acts, the standard public booking is 3 x 45 minute sets with one 20 min break after the first set and one 25 min break after the second set. If you wish to adjust this, for example having an additional 45 min set, please specify in enquiry, as variations may be available upon request.

  • Deposits are not applicable for gigs booked with public venues.

  • See invoice for terms of payment.

  • Cancellations on the part of the venue within 24 hours of performance date and time will incur a 50% cancellation fee of total chargeable rate for the booking.

  • Any photographs/video footage taken of performers at a public venue by the venue may not be sold/profited from without written consent by the performer.

PRIVATE EVENT BOOKINGS

Deposit:

  • A 30% booking deposit is required to secure performers’ services for the date of a wedding or private event. The deposit amount is calculated based on the total cost of the services being booked.

  • By way of making deposit, the client is agreeing to the terms and conditions detailed below.

  • Please note that a booking is not confirmed until a client’s deposit has been received.

Scheduling:

  • If the time/date/location or further details specified by a client at a later date contradict previous communications, inclusions and/or original quotes, additional costs may be incurred, as per the new requirements.

Meals:

  • You will need to provide one meal per person for any package that takes place over the course of a reasonable dinner time (around 5-9pm). Solo artist = one meal. Duo = two meals, etc. This is industry standard, and the venue or catering company will be able to organise this with you. Clients can assume that there are no dietary requirements unless otherwise stated.

Private Property Weddings

  • If the client does not have a venue manager, someone must be appointed as a contact for me to liaise with on the night, regarding any issues that may arise.

  • If the private property is difficult to find, detailed instructions about how to locate the venue, and a number to call in case of any difficulty finding the property must be supplied.

  • A flat/dry surface must be provided for performers/the band to perform on. Adequate cover to protect our electrical equipment from rain is vital.

Flight Prices

  • If flights are required for a job, prices will be quoted that are valid at the time of the enquiry. As a result, if it takes weeks/months for the booking to be confirmed by way of making deposit, then the flight prices originally quoted may be subject to change.

PAYMENT STRUCTURE FOR SERVICES ARE AS FOLLOWS:

  • Soloist/Duo/Band bookings:
    30% deposit required in order to confirm booking.
    70% balance remaining due two weeks prior to wedding/event.

  • Any quotes or inclusions issued are valid for 14 days.

CANCELLATIONS / POSTPONEMENTS

  • Payment of a deposit invoice, along with written confirmation by email, constitutes a binding agreement (“Performance Agreement” or “Agreement”) between the Client and the Performer. This Agreement also includes acceptance of this Cancellation Policy and all other terms of service as outlined on the Performer’s website.

  • 1. Definitions:

    Total Contracted Fee: The full amount specified in the invoice provided to the Client, including all performance, travel, and equipment charges.

    Deposit: The non-refundable amount equal to 30% of the Total Contracted Fee.

    Booking Confirmation: The date upon which both the deposit has been paid and the Client has provided written confirmation of the event details via email.

  • 2. Non-Refundable Deposit 

    2.1 A non-refundable deposit of 30% of the Total Contracted Fee is required to secure the Performer for the specified date.

    2.2 This deposit will be applied toward the Total Contracted Fee.

    2.3 The deposit is non-refundable except in cases where the Client cancels the booking in writing within 14 days of payment and written confirmation (cooling-off period).

    2.4 If cancellation occurs within this 14-day period, 100% of all amounts paid (deposit and any further instalments) will be refunded.

  • 3. Cancellation by the Client

    3.1 All cancellations must be made in writing via email and acknowledged by the Performer to be valid.
3.2 Cancellation Fee Schedule:

    • More than 90 days before the event: 30% of the total contracted fee - the non-refundable deposit is forfeited. 

    • Between 30–90 days before the event: A cancellation fee of 50% of the Total Contracted Fee will be charged. Any deposit already paid will be applied toward this amount.

    • Within 30 days of the event: The Client will be responsible for payment of the total contracted fee. 

    3.3 These fees represent a genuine pre-estimate of loss to the Performer, including loss of potential alternative bookings and administrative costs.

    3.4 Any cancellation fee will be offset by payments already made. If the amount already paid exceeds the cancellation fee, the difference will be refunded.

  • 4. Postponements & Configuration Changes

    4.1 A one-time free postponement may be requested within 14 days of the Booking Confirmation, subject to Performer availability and the new date being within 12 months of the original event. The Performer is under no obligation to accommodate the requested date if unavailable.

    4.2 Postponement requests after 14 days of the Booking Confirmation are treated as cancellations, and a new booking and deposit will be required.

    4.3 Requests to reduce the agreed performance setup (e.g. changing from full band to solo act) that result in individual performers being no longer required will be considered a partial cancellation. A fee of $180 per cancelled performer will apply.

  • 5. Force Majeure 

    5.1 Neither party shall be liable for delays or failure to perform due to events beyond their reasonable control, including but not limited to acts of God, war, severe weather, government restrictions, pandemics, or natural disasters ("Force Majeure Events").


    5.2 If a Force Majeure Event renders performance impossible:

    • The Agreement will be deemed null and void.

    • Any funds paid, excluding the non-refundable deposit, will be refunded.

    • If rescheduling is feasible and agreed upon by both parties, the Performer may apply any retained funds (excluding the deposit) toward the rescheduled date.

    • The Performer will make reasonable efforts to reschedule based on availability.

  • 6. Cancellation by the Performer 

    6.1 If the Performer must cancel due to circumstances within their control (e.g., illness, double-booking), the Client will receive a full refund of all amounts paid, including the deposit.

    6.2 The Performer may offer a substitute performer or act, subject to Client approval, but the Client is not obligated to accept a substitute.

  • 7. Safety & Conduct Clause

    7.1 The Performer reserves the right to cancel the booking or cease performance, without obligation to refund, in the event of:

    • Unsafe or illegal performance conditions

    • Abusive or unlawful behaviour by guests or venue staff or management

    • The event substantially differing from the agreed terms (e.g. venue, timing, or scope)

  • 8. Disputes & Governing Law 

    8.1 This Agreement is governed by the laws of New South Wales, Australia.

    8.2 Any disputes arising from this Agreement shall be resolved in the appropriate courts or tribunals of New South Wales.

PERFORMANCE PACKAGE OPTIONS

  • Charlie Owen Solo Acoustic

  • Charlie Owen Duo Acoustic

  • Charlie Owen Band (5 piece standard band)

  • You are welcome to select any configuration of the above that you would like, (eg. acoustic solo/duo for your ceremony and a canapé/social hour, and band for the reception. Or just one or the other, if for example you plan to have a DJ for the reception but still want an acoustic social hour/ceremony music)

  • You can choose 3 live songs for your ceremony (generally for down the aisle, signing of the register, and celebration/back up the aisle). Song learning is included in all packages. Beyond these 3 songs for the special moments, we are happy to consider any other songs you have in mind; however, additional live songs may incur further charges due to the time involved in the song learning process. We’ll endeavour to accommodate all requests, but it may not be possible on all occasions.

  • The Solo/Duo + Band package covers the full day of a standard wedding, approx. 8 hours (3-11pm-ish). If it’s significantly longer than 8 hours, there will be additional charges. If it’s a few minutes here and there, then that’s not a problem; but, for example, a 2pm ceremony with a midnight finish will incur further charges. This package includes ceremony music, a canapé/social hour and the reception sets.

  • The standard band reception packages are based on a start/finish time of 4 hours. Please note the definition of “start time” which is defined as the time the band is required to have finished set up and sound check at the venue, and are ready to play. “Finish time” = The time the band can finish playing, and commence packing up equipment.

  • The band prices are based on 3 x 45 sets within the 4 hour performance period. With most running schedules for weddings and events, this is typically 1 x 45min “chilled set” – where the band plays relaxed modern covers, and 2 x 45 dance sets, where the band plays upbeat dance material. Importantly, the set times do not have to strictly follow the 3 x 45min formula. For e.g. a chilled set early on could be 30min and a dance set later on could be 60 min. The main rules to remember; are that a set cannot exceed 1hr, and the total playing time for the band can not exceed 3hrs, within the standard 4 hour booking. There must also be a 15 minute break (minimum) between each set where I control DJ music through my PA system.

  • I will supply appropriate background music during band breaks which is connected to the PA system provided. This is included in the price. Clients are welcome to supply their own Spotify list to be played through my PA system if preferred.

  • Performers will arrive 60 – 70 minutes before the due start time. For e.g. if we are booked to perform at an event which is 6:30pm – 10:30pm, we will arrive at 5:20pm. If a client or the venue require the band to set up earlier than this, then an additional charge may be involved.

  • For any bookings that exceed 12am, an additional fee of $70 per musician will be charged, per each additional 30mins.

  • Of the 3 x 45min sets, the first set must be a more chilled out/background set. It is fine to have the next two sets as high energy/upbeat dance sets, but it is physically too demanding to schedule the whole gig as uptempo dance sets.

PERFORMANCE SET UP LOCATIONS MUST INCLUDE THE FOLLOWING:

  • A dry area which is under cover. We can perform outdoors without cover for ceremony and canapés performances (assuming it isn't raining), but for the reception we require a roof over our heads at the very least. Our equipment cannot get wet. Wet equipment is a serious hazard for our musicians and guests.

  • If the area has open walls where the band is set up then heaters must be on hand.

  • We also require a flat, dry and hard surface to set up on.
